Will I go to prison?
Whether or not a person goes to prison, depends on several factors. Age, seriousness of the offence, the strength of the evidence, and any mitigation such as having no previous convictions, can all make a difference. Don’t forget that nobody can go to prison unless they are either convicted after a trial or plead guilty. An accusation is not enough on its own.
Will the police provide all of the evidence before I am interviewed?
The police will provide something called 'disclosure'. This is often basic information summarising what the allegation is, but this does not include all of the evidence and they may even withhold information.
Can the police seize my belongings?
Like any other investigation, the police are entitled to seize your belongings if they are relevant to the case. Things such as phones, iPads and clothing may be relevant in a case like this. The police will be searching for anything which might assist them in trying to show you are guilty. Anything that is seized, we will ensure they are also looked at by a defence expert and that the police have done things properly.
What if I do not have my own solicitor?
You can always request a Duty Solicitor who will provide free and independent legal advice for the purpose of the interview.
