Our client pleaded not guilty to three domestic assault charges and criminal damage. However, he accepted that he was in possession of Cannabis. The prosecution offered no evidence and the client received a conditional discharge.
Case study
Following a disagreement with his girlfriend, our client was falsely accused of assault by beating, assault occasioning actual bodily harm, strangulation, and criminal damage.
We discussed the case with our client and he explained that his relationship with his former girlfriend had began to deteriorate and she would often become aggressive towards him. On the day of the alleged offence, his former girlfriend had attacked him and damaged their property. Our client left the house and was later arrested by police, when searched, the police found a small amount of cannabis in his possession.
We encouraged the prosecution to reassess the evidence and they drew the conclusion that they did not have sufficient evidence to proceed with a prosecution. As such, the charges against our client were dropped.
Our client had previously accepted possession to the small amount of Cannabis and, after careful mitigation put forward by our expert lawyers, he received a 6-month conditional discharge.
