Case study summary
Our client was falsely accused by his wife of coercive and controlling behaviour and non-fatal strangulation. Following comprehensive pre-charge representations, the CPS concluded that no further action should be taken against our client
Case study
Our client was a professional male in his early 50s with a spotless record. Having worked as a teacher for 30 years and being subjected to regular records checks the prospect of being charged or convicted was terrifying – and potentially career-ending.
Our client and his wife met online, and she moved to the UK from overseas on a spousal visa. The marriage was not all plain sailing and the couple regularly had heated arguments. When the marriage looked to be over our client was subject to a series of false allegations relating to both physical and psychological abuse.
He strongly suspected that the allegations were made so his wife could remain in the UK on a domestic violence visa.
Through careful and thorough preparation and analysis of underlying material, we made a compelling argument which undermined the allegations. Despite battling an entirely uncooperative police officer – whom we ultimately had to bypass – we liaised directly with the CPS who understood our position.
All charges were dropped, and our client could continue teaching and rebuilding his life.
