Our client, a man of good character, was accused of common assault against his flat mate. Prior to interview, we prepared a comprehensive prepared statement on his behalf which set out his denial and version of events. Consequently, the police took no further action.
Case study
Our client was accused of assaulting his flat mate by lunging at him with a closed fist. He is a man of good character who was never had any dealings with the police. We came to represent this client in interview upon his arrest. After speaking with the officers to get a full understanding of the allegation, we were able to have an in-depth discussion with out client prior to the interview.
It was the clients’ instructions that he had simply asked the complainant to clean up his mess, and when he was ignored he just simply put his hand on the door to encourage the complainant to listen to him. We advised our client that he should put forward a full account in interview by way of a prepared statement.
With his agreement we prepared a full and detailed statement. It was because of this that the police decided that same day to take no further action that same day, regardless of the fact that they had a witness statement supporting the complainant.
The client was extremely grateful for our assistance in getting this matter dealt with at such speed, which meant that he was able to avoid the stress of an investigation.
