Case study summary
Our client had been accused of criminal damage, threats to kill, ABH and controlling behaviour. These were all false allegations made by an ex-partner following a break-up. We made sure the police knew the reality and as a result the case was dropped immediately.
Case study
Our client came to us after a number of serious and damaging allegations were made against him. Heaving been arrested and interviewed, a series of false incidents had been put to him in interview and denied. Our client knew he needed specialist lawyers to ensure that the police were informed of the truth.
During our first conference, it became clear that our client's wellbeing was at risk. Not only had he recently split up with a long term partner, but it was now this same person who had accused him of these offences. He was adamant it was all lies and he gave us in-depth instructions on the reality of the relationship. From here we could see that it was our client who had been subject to a controlling partner and not the other way around.
Knowing that the case was being sent to the Crown Prosecution Service shortly, we worked quickly with our client to collect evidence that supported his instructions. This included videos of his partner turning up at his door, the day of his arrest, and shouting that she didn't mean it. We also collected numerous messages showing the control he himself had been subject to. This evidence was all set against the backdrop of glowing character references we had obtained.
Thankfully, due to our efforts and the police acknowledging the evidential difficulties in this case, it was decided that no further action would be taken. This allowed our client to not only avoid prosecution for offences had did not commit but completely move on from a difficult time in his life. He is now back around the support of his family while pursuing a new career and a fresh start.
