Case study summary

Our client was arrested after she was accused of assaulting a woman who she was being investigated for in relation to another offence.

We used a prepared statement to set out our client's case and the case later received No Further Action.

Case study

Our client had been under investigation after allegations were made that she had assaulted the complainant by hitting her with a bag.

We attended the police interview and spoke with the investigating officer to find out more information about the case. The officer had no choice but to admit that they did not have evidence to support the allegation, other than a vague statement from the complainant.

We advised our client accordingly and she explained that she denied the allegation because she was not in the area at the time and had not even seen the complainant.

A prepared statement was drafted to advance this defence and was read out at the start of the interview on our client's behalf.

Less than one month later, the police chose to end their case because they did not have any evidence to disprove our client's defence.
