Our client was a young man accused of a horrific crime against his cousin when they were both young children, around 9-10 years old. His cousin had given a detailed video account to the police, 10 years later.
He instructed our specialist rape solicitors and we attended at the police station. We carefully took instructions and discussed the allegation with the police. It soon became apparent that, despite the complainant supporting a prosecution, his account was inconsistent. We raised this with the police and our client refused to answer questions in his interview.
After several months of chasing the police and reminding them of their duty to investigate serious allegations like this one properly and quickly, they decided to take no further action. The police stated that their decision was down to the complainant no longer supporting a prosecution and because there was no other corroborating evidence.
Our client was overjoyed at the outcome and is able to return to his family without the burden of a rape investigation hanging over his head.
