Case study summary

We were instructed by this client to prepare and represent her in respect of a totting up offence.

We drafted detailed mitigation from her instructions and were able to persuade a Magistrates' Court to only impose a short ban and a fine.

Case study

Our client came to us after she received an additional three points on her licence, which would have taken her to twelve in total.

She was especially concerned that a disqualification or lengthy ban would harm the philanthropic work she did abroad - thereby harming those who benefited from this work.

We prepared her case by taking detailed instructions about her work and the benefits that it brought. Our client explained that she was responsible for a large amount of the driving done abroad and that the charity was heavily reliant on her ability to transport and organise the operation.

We also instructed an expert barrister to represent her at the exceptional hardship hearing and served character evidence to the court.

The result of the hearing being that our client was given a short ban which would not result in her needing to take another test and that after the banning period had ended, she would have a completely clean licence.

Our client was relieved by this result and happy to be able to focus on her work abroad without the constant worry that her crucial role in this work would be lost.
