Case study summary
MMS represented a professional lady accused of forging fraudulent prescriptions. She instructed our firm soon after her first interview. We submitted detailed representations with supporting evidence to the police. The case was eventually dropped with No Further Action.
Case study
Our client was a professional with an exemplary background. She had never had any dealings with the police in her life and was in complete shock when she was arrested following an allegation of forgery, which she completely denied.
She was was represented by a duty solicitor in her initial interview but contacted us soon after, as her entire career was at risk due to the nature of the allegations.
She quickly instructed us to represent her following her initial consultation with us. We then worked as fast as possible to gather information from the previous firm and then take detailed instructions from our client. After going through a meticulous process of assessing what information or evidence could support her defence, we drafted detailed written representations which were submitted to the police. This carefully set out arguments why our client should not be charged and information to help establish her innocence.
Due to the complex nature of the investigation, it went on for more than a year, with our client being further interviewed. In that interview, a prepared statement was drafted in advance and submitted. This meant that a clear and concise response could be given to the information that the police had disclosed, after which our client answered no comment to all further questions, despite suggestions made by the police that it was not in her best interests to do so.
We were later notified that that investigation was being closed without any charge and No Further Action being taken against our client. This was crucial, as not only was she cleared of the allegations, but this meant that she had no criminal record which was essential for her career.
