Case study summary

Our client pleaded guilty to possessing and distributing over 60 indecent images of children. At the time of the offending, he was misusing alcohol and drugs but he had since turned his life around. We persuaded the court to impose a community order rather than a prison sentence.

Case study

Our client was a 23-year-old who had recently began his own business. In March 2023, he was charged with possession and distribution of indecent images of children and extreme pornography. Our client admitted the allegations and pleaded guilty at his first available opportunity. The case was then sent to the Crown Court which meant that there was a real possibility of our client receiving an immediate prison sentence.

Our client contacted us and asked us to represent him. He feared being sent to prison because he helped to care for his mother who suffered with reduced mobility as a result of chronic back pain. He explained that, at the time of the offending, he was 21-years-old and he was struggling to cope with the breakdown of his mother and father's marriage. He turned to alcohol and drugs to cope with the tension at home. Whilst intoxicated, he would then visit pornography websites and join different chatrooms. Indecent images of children and extreme pornography were distributed into these chatrooms which our client admitted he then distributed on to others.

Our client regretted his actions and believed that it was as a result of his alcohol and drug misuse at the time which he had since received help for. He had no previous convictions and he had a promising future ahead of him with his own business.

We ensured that the court were aware of our client's good character, deep shame of his offending and the maturity he had developed since. This resulted in our client receiving a community order rather than a prison sentence which he was extremely relieved about.
