Our client had been to a party and had consensual sex. Soon after he was accused of rape, arrested, and taken to the police station. We advised him before his interview and carefully prepared a statement that was read out on his behalf. The investigation was later dropped.
Case study
MMS represented a man who had been to a party where he met a woman. They got along and eventually ended up having consensual sex. To his complete shock, police arrived at his address and he was arrested following an allegation of rape being made.
We were instructed to represent him for his police interview and contacted the police to obtain as much information as possible in the disclosure process.
We then had a private conference with our client, in which we took detailed instructions about what had happened throughout the entire night and following day. We then drafted a carefully prepared statement to set out as much detail as possible, including details of potential witnesses, to help establish that lots of the things that he had been accused of were not actually possible. This helped support his account and show that our client was in fact telling the truth and that they had sex consensually.
The police confirmed that No Further Action would be taken against him and the investigation had been dropped.
