Case study
We were approached by our client following an interview with Cambridgeshire police. He had been accused of the kidnap and sexual assault of a man he had met online. As a man of good character, who always denied these allegations, he knew he needed specialist lawyers to prove his innocence. After reading about our experience with pre-charge representations, he contacted us and a conference was set up for the next day.
During the first conference, we took the time to take in-depth instructions from our client. He explained that he met the complainant on Grindr and knew him as a 21 year old. The two of them had mutually agreed to meet up and spend the evening at our client's home. Fast forward a few hours and our client found himself inebriated on the stairs, being arrested with the complainant no where to be seen.
We then learnt that our client had been filmed by the complainant. The videos had been stored on our client's phone and showed him in a compromised state. It was clear that our client physically could not have acted in the way the complainant described. Other videos showed the complainant trawling through our client's house and going through his wallet. From that moment on, we knew we needed to prepare comprehensive representations to the police.
With the client's consent, we shared seven videos, and a number of photographs, which supported his account. After taking the time to consider our representations, the police accepted that both allegations were false. It only took them three days to make this decision. As a result, our client's name was cleared and he is now able to focus on recovering from the effects of having such malicious allegations made against him. This is something we continue to support him with.
