Our client met the complainant on a night out. She went back to his hotel room where they had consensual sexual intercourse. However, one month later, she accused our client of rape. We provided our expert legal advice during the police interview and the case was dropped.
Case study
Our client was a 29-year-old who worked in computer software development. In July 2022, he was on a night out with his friend in Huddersfield. He met a female and they decided to go back to a hotel for the evening where they had sexual intercourse. One month later, the female accused our client of rape.
Our client called us and asked for our help. He explained that the police had contacted him and asked him to attend the police station for an interview. He had no idea what this was regarding because he had never been in trouble with the police before. This made him very anxious to the point where he had to take time off work due to stress. We immediately contacted the police to confirm what the allegation was. We were informed that our client had been accused of raping a female in Huddersfield in July 2022. We then discussed the allegation, and the interview procedure, with our client to help ease his nerves. From this point onwards, our client knew that we were the right lawyers for him.
Our client denied the allegation. He explained that he met the complainant in a nightclub in Huddersfield. He and his friend left the club to go to McDonalds where they saw the complainant again. Our client and the complainant kissed and she decided to go back to our client's hotel room with him. Whilst in the hotel room, they had consensual sexual intercourse twice.
During the police interview, one of our expert sexual assault lawyers challenged the allegation which had been made against our client. He was able to find out that there was CCTV which showed the complainant walking to the hotel room with our client and his friend. However, the police could not confirm whether the complainant still wanted to support her original complaint. She had also not provided a formal statement. We then discussed the evidence with our client and provided our expert legal advice for the interview.
Just over one-month later, the police confirmed that they had dropped the case. Our client was relieved and looked forward to returning to work without the stress of a false allegation hanging over him.
