Case study

Our client was a professional lady who had no experience of the criminal justice system. She was accused of s.39 Assault by beating following a dispute with a neighbour.

She had been represented by the duty solicitor and charged following her arrest and interview. She contacted our firm to seek advice on the court stage of proceedings, as she completely denied the allegation and wanted to fight her case to protect her good name and career.

We were instructed to represent her following the initial meeting, and we set about to prepare her defence from the very outset. This involved going through and analysing the prosecution evidence in detail and then taking her detailed instructions. We then drafted a detailed defence statement making specific requests to pressurise the prosecution to provide us with further relevant evidence that had been withheld.

A specialist barrister was instructed to present and argue her defence at trial. Despite numerous delays and attempts by the prosecution to prevent us from properly presenting our defence, we successfully convinced the court to see the true version of events and our client was found not guilty.

The process had been incredibly difficult for her with her life effectively going on hold for months until it was resolved. She was delighted with the outcome and expressed how grateful she was that she had chosen MMS to fight her corner and get the right result.
