Case study summary

Our client assaulted a bouncer after being denied entry into a nightclub. One of our expert defence lawyers represented him at his police interview and persuaded the police to deal with the matter by way of a caution which meant that he avoided court and a criminal conviction.

Case study

Our client was accused of assaulting a nightclub bouncer after being denied entry. The allegation was that he had climbed over the venue's fence and struck the complainant in the face. The incident resulted in police attendance and the client's subsequent arrest.

One of our expert defence lawyers represented our client at the police station. At the station, they were able to view the CCTV footage which captured the incident clearly and they advised the client on the strength of the case and the potential outcomes.

Our client admitted the allegation and wanted to apologise for his actions. We carefully drafted a statement which accepted responsibility and showed remorse for his actions in an attempted to resolve the matter without our client having to go through lengthy and distressing court proceedings.

Given the client's lack of previous convictions, genuine remorse and acceptance of responsibility, our lawyer was able to persuade the police to deal with the matter with a conditional caution. The agreed condition was that the client has to write a formal letter of apology to the complainant which he was more than willing to do. The matter was successfully resolved out-of-court, and our client avoided a criminal conviction.
