This client approached us for representation following his first interview in early 2023. We continued to represent and support him all the way to his sentencing at the end of 2024.
We were able to persuade a judge to suspend his sentence, following an early guilty plea.
Case study
Our client was an elderly man who had previously not had any involvement with the criminal justice system but was then under investigation for possessing and distributing indecent images. He explained to us that a series of life events had led to him developing unhealthy habits. He fully accepted the seriousness of the case against him and we worked with him to prepare for his inevitable sentencing from an early date.
We drafted lengthy and detailed mitigation for our client, including all of the work and effort he had put into his own rehabilitation since his first interview. This included engaging in therapy and contacting the Lucy Faithful Foundation - details of which were valuable mitigation for him. We also took details of circumstances that led to this offending and were able to place this in its proper context.
We instructed expert counsel, Ashleigh Heyworth of 33 Bedford Row Chambers, to represent our client and present his mitigation to the Judge. We argued that our client had demonstrated how he meant to continue his life, by seeking help, and that he had demonstrated his remorse from an early stage. It was also highlighted that he had been a man of good character, with no previous convictions.
There was no guarantee of a suspended sentence, given the seriousness of the case, and our client attended Court with a packed bag in the event that he was sentenced to immediate custody. However, we were able to persuade the Judge to do this and spare our client from prison.
Our client have been understandably terrified of the outcome of this case and his mental health had suffered immeasurably while waiting for his court hearing. He was grateful for the support he had received and the care taken with his case which finally allowed him to return home and continue with the progress he had been making.
