Our client was a family man, with long history of drug abuse. He was accused of financally benefiting from criminal activity and became the subject of POCA proceedings which had reached the Crown Court. We made a successful challenge to discontinue the case.
Case study
Our client was serving a prison sentence and recoevering after recently withdrawing from multiple drug addictions. He was also suffering from complex mental health issues. He was accused of finically benefitting from criminal conduct and as a result was subject to POCA proceedings.
We quickly took control of the case and spent many hours with the client, assembling his financial history and assets. We realised that our client had not finically benefitted from any criminal conduct and were able to challenge the prosecution case, instructing a specialist barrister to advocate for him at court.
Once the proceedings began, the prosecution had no option but to discontinue the case and stated they would take no action in trying seize our client's assets.
As a result of this, our client is free to do what he wishes with his finances. This was a case that required a proactive and specialist approach when guiding our client through a difficult process.
