Case study summary

We represented a working man who had been accused of possessing indecent images. He accepted this, but explained he had been suffering with an extreme pornography addiction.

We represented him at his interview and drafted a prepared statement arguing for a caution.

Case study

Our client approached us following a police interview in which he was accused of having possession of indecent images of children. At this interview he was represented by a duty solicitor, but after this interview he decided to seek expert legal representation.

During the interview, police seized his mobile phone and after months of waiting they provided the results of the download. We engaged with this report and advised our client on it's implications.

We took detailed instructions from our client who explained that he had been struggling with a pornography addiction since he was young, which had become progressively worse until it reached this point. He had since taken steps to address this addiction and was going to regular therapy to begin to understand and control this addiction. We provided further advice and recommended contacting a number of charities and support groups to strengthen an argument for No Further Action.

We carefully drafted a prepared statement and attended the second interview with our client where our expert lawyer argued in favour of a caution and made it clear that our client was taking steps to address the issues he was facing.

Ultimately, the police had no choice but to agree to give a caution in this case and our client was able to continue with his life without the stress of a court case or the weight of a criminal conviction to deal with.
