Our client was accused of fraudulently obtaining thousands of pounds from his ex-partner. We advised him and carefully prepared a statement setting out his defence, which was then read out during the interview. After the police had considered our statement, they dropped the case.

Case study

Our client had been in a relationship that ended on bad terms. He had never been in trouble before and had no previous experience with the police.

After the relationship ended, his ex-partner accused him of making false representations to obtain money. He was asked to attend a voluntary interview by the police, who were investigating him for Fraud by False Representation contrary to s.2 of the Fraud Act 2006.

Having never been in trouble before and because the interview was 'voluntary', he did not know if needed a solicitor or not. However, he contacted our firm and after receiving advice from one of our specialist fraud lawyers, he instructed us to represent him during the police investigation process.

We requested information from the police in advance of the interview, so this could be considered in detail and we could then advise our client. Once he had explained his side of the story, we set this out in a carefully written prepared statement, which was then presented to the police at the beginning of the interview, and our client then answered no comment to all further questions.

Following this, once the police had investigated further and looked into our client's version of events which was set out in his statement, the police confirmed they would take No Further Action and the investigation was closed.

Our client was very relieved and explained that his life had been on hold after being accused, but he could now move forward.
