Case study summary

Our client was accused of rape after taking a woman out on a date. He always denied the allegation and had lost everything as a result. He felt all hope was lost. Due to our comprehensive representations, the police dropped the case and our client's name was cleared.

Case study

We were contacted by our client after he was arrested and interviewed on suspicion of rape. As a 27 year old man of good character, he was distraught. He had lost his job and all of his friends turned on him. When he felt as though all hope was lost, he reached out to us looking for support from specialist criminal defence lawyers.

Through several conferences, we were able to work with our client to piece together the evening in question. He explained that the date had gone well, with the complainant inviting him back to her home. Having been friends prior to the date, the two of them already shared a level of trust. Back at her home, they engaged in mutually consensual sex. Our client recalled things that the complainant did and said during sex that reassured him of her consent. He maintained that he would never force anyone to do something they did not want to do.

Knowing what was at stake, we worked quickly but carefully to draft representations to the police. This set out our client's account and explained how the evidential test would not be reached. After taking time to consider the representations, the police rightfully decided to take no further action against our client. Following many months of turmoil, our client was overcome with emotion knowing that his innocence had finally been proven.
