Our client received a suspended sentence for possession of a bladed article. An immediate prison sentence had been a real possibility given his previous convictions, however, we worked to highlight his good character, responsibilities and remorse to the court.

Case study

Our client instructed us after being charged with possession of a bladed article. Whilst in a bar, he found a pocket knife in his pocket and waved it around in a joking manner. Our client was extremely remorseful and regretted his actions deeply so he pleaded guilty at the earliest opportunity.

Knowing that this offence crossed the custody threshold, meaning an immediate prison sentence was a real possibility, we worked with our client to obtain as much information as we could from him to present as mitigation. He was a father to 7 children, one of whom was very reliant on him as he was his carer. It was very important for our client to be able to continue to care for and support his family. However, he had previous convictions for possession of a bladed article, albeit several years ago, which was a further challenge for us.

One of our experienced court advocates presented strong and persuasive mitigation to the court which resulted in our client receiving a suspended sentence, thus avoiding prison. He and his family were extremely happy with this result.
