Case study summary

Our client was a young man who was involved in supply of controlled drugs. Although the prosecution tried to suggest his involvement was more serious, follow careful mitigation argued by MMS, the court accepted he was in the lowest category and sentenced him to a community order.

Case study

Our client was a young man with no previous convictions. Following a difficult period in his life he became involved in drug supply and was charged with Being concerned in the supply of a controlled drug contrary to s.4 of the Misuse of Drugs Act 1971.

Mary Monson Solicitors were instructed to represent him for the court stage of proceedings. We quickly obtained the evidence from the prosecution to assess the best to deal with his case and advise our client. Having never been in this situation before, we provided careful guidance to give him the best chance of achieving the best outcome in his case.

At court, the prosecution presented the facts of the case and suggested his role was more involved putting him into a more serious category of offending. Having taken detailed background information and carefully prepared his mitigation in advance, we were able to make detailed submissions at the first hearing. We persuaded the court that our client fell into the lowest level of offending and as a result, he was sentenced on that same day with the court giving him a community order.

Our client was very relieved as he had been terrified at the possibility of going to prison. As a result of the sentence, he was able to get the matter resolved as quickly as possible and move forward with his life. He was incredibly relieved telling MMS that we had given him hope for his future.
