Case study

Our client was a student who engaged in consensual sex during an encounter with a transexual man at university. Following the incident, after half-term break, he was arrested due to an allegation of rape. In interview, our client opted for the duty solicitor and answered no comment to all questions. He also provided a prepared statement which did not address all the key points in the case.

Upon being released from custody, he instructed our firm, with the goal of preventing the false allegation from ever becoming a formal charge. Our specialist sexual offences solicitors began work immediately by contacting the police to assert all communication be channeled through us. We also took detailed instructions from the client which allowed us to identify elements of his first prepared statement which needed clarifying.

We then drafted a further prepared statement which supplemented the first, and provided a full account of the incident. This was submitted to the investigating officer who, after a further few months, discontinued the investigation.

Our client is able to continue his studies and pursue his career without having to suffer through criminal proceedings.
