Case study summary
South Wales Police drop a false rape allegation against our young client following comprehensive written submissions. Our client was falsely accused by his ex-girlfriend of failing to stop after she withdrew her consent.
Case study
Our client was a newly qualified teacher who was beginning his first full-time placement. If the allegation progressed his career would have been over before it began.
The allegation came from an ex-partner who had a history of mental health issues. She claimed to the police that our client had continued to have sex with her after she had withdrawn her consent.
It didn’t help that our client had sent messages to the complainant the next day apologising for his actions. Once we sat down and spoke about these it quickly became clear that our apologies were only made to appease someone who was emotionally very unpredictable.
At the police station, we put forward a comprehensive prepared statement which served as the basis for our later, written representations. Those representations were thorough and detailed and identified further lines of enquiry for the police.
Following a long and drawn-out investigation the right decision was finally made and no further action was taken.
