Case study

Our client was a 68-year-old man who was registered as disabled. In April 2024, he was contacted by the police and asked to attend a voluntary interview in relation to historic sexual allegations which had been made against him by his niece and her sister. Our client and his wife, who was also suffering with medical conditions, contacted us in a panic as they were shocked and devastated that he had been accused of such serious allegations.

The particulars of the allegations were that our client's nieces had accused him of sexually assaulting them when they were children. One of his nieces reported him to the police in November 2023 but then decided that she no longer wanted to support a police investigation. The second complainant did not make a report until three months after the first complaint.

Our client wholly denied the allegation. He was in disbelief that the allegations had been made and he was supported by his wife who confirmed that he had never been left alone with their nieces when they were children and she would have always been present. We then contacted other family members and friends who echoed the support which our client's wife gave our client and provided references for him. We also collected phone evidence which showed that the two complainants would regularly ask our client and his wife whether they could visit them and stay overnight at their address and these requests continued up until a few days before the police reports were made. This supported our client's account.

We attended the voluntary interview with our client and provided our expert legal advice. Following the interview, the police decided to take no further action. Our client and his wife were extremely relieved and they were grateful for the support that we had provided to them throughout the investigation.
