Case study summary

Our client faced two charges of sexual assault. He completely denied the allegations from the outset and instructed us to represent him after he had been charged. After almost a year of preparing his defence, he was found not guilty of both charges following a Crown Court trial.

Case study

We represented a client accused of sexual assault contrary to s.3 of the Sexual Offences Act 2003. This came as a complete shock to him, as he was nearly 60 years old and never had any dealings with the police in his entire life apart from a minor road traffic offence. He had worked hard for many years and was highly regarded and well-liked amongst his friends.

One of those friends contacted our firm to see if we could help, as our client had no idea what to do having been thrown into the criminal justice system following these accusations. After that initial conversation, our client swiftly made the decision to instruct us for the court proceedings, as he had not had any legal representation in his police interview.

During months of preparation, we meticulously went through all of the prosecution evidence to assess and highlight differences in the various accounts given by the complainant and other witness statements to demonstrate the allegations were untrue. We also took detailed instructions from our client, as well references from people who knew him best to talk about his character.

We instructed expert counsel as part of his defence team and made sure she was fully briefed and had every detail needed for cross examination and legal submissions. Following trial, the jury returned with unanimous not guilty verdicts on both charges.

Our client's life had effectively been on hold for over a year but he said he was able to start living again following the result.
