Our client came to us after being charged with Speeding and Perverting the Course of Justice. We ensured that he did not go to prison and that he could continue to look after his young family.

Case study

Our client was caught speeding and received a Notice of Intended Prosecution. Out of panic and worry that he would lose his license, something he relied on in day-to-day life, he named his mother as the driver rather than himself.

He was later arrested and gave full admissions from the initial interview and accepted what he did was wrong. Due to the seriousness of this offence after his first hearing in the Magistrates' Court, this case was committed to the Crown Court.

Our difficulty was that Perverting the Course of Justice is an offence that is taken very seriously by the courts and often has a starting point of custody.

We worked alongside our barrister to ensure that we could effectively mitigate for our client and explain how this was completely out of character and done out of worry. Our client had a young child who he had to take to school and back everyday, a business to run and an elderly mother to care for.

Our hard work paid off as the Judge accepted our mitigation and sentenced our client to six months imprisonment, suspended for eighteen months. This meant that our client was able to get on with his life and stay with his family.
