Case study

Our client was a father who relied on being able to drive for childcare and his business. He was caught speeding at 85 mph in a 60 mph zone and admitted the offence. We faced further difficulties when he informed us that he already had 6 penalty points on his licence. There was a real risk of our client being disqualified from driving but the impact which this would have had on his personal and work life would have been devastating.

When our client received his summons, he instructed us to represent him at court. We prepared the case thoroughly by obtaining detailed instructions from him. Our client informed us that he is required to drive to multiple locations across the country as part of his job as a master brewer. He also had 4 young children who attended nurseries and schools which were not within walking distance from his house. We obtained statements from our client's family members and colleagues to support the reliance he had on being able to drive.

We instructed a barrister with expertise in motoring matters called Paul Williams of Lincoln House Chambers. He met with us and our client prior to the court hearing to ensure that he could also contribute his ideas to the case preparation.

At court, Mr Williams was able to use the abundance of helpful mitigation material which we had collected and prepared to persuade the court to impose 5 penalty points - this was the maximum our client could receive before being disqualified and meant that he was able to retain his licence. Our client was extremely pleased with this result.
