Case study summary

Our client was accused of being the ringleader in a Fraud worth hundreds of thousands of pounds from mis-selling products. He strongly denied this and at trial, the prosecution dropped the charge and accepted a much lesser charge for which had to complete unpaid work as a result.

Case study

Our client was businessman accused by Trading Standards of mis-selling products in the solar energy industry. He was one of 10 defendants charged in a Conspiracy to commit Fraud, and it was suggested that he was one of the leaders of the group.

The case took over two years to get to trial from the date of charge, and required hours of meticulous preparation and going large volumes of paperwork provided by the prosecution.

We instructed an expert KC and barrister who both specialised in Fraud offences. After years of preparation, by the time the case had reached trial we managed to persuade the prosecution to drop against our client despite the fact that he was accused of being the main ringleader. The prosecution accepted a guilty plea to a much lower charge of receiving a small amount of money from one the of the other defendants accused of being involved in the fraud.

Based on this lesser charge, our client was not sent to prison and instead had to complete unpaid work as his punishment. We also negotiated so that there would be no confiscation proceedings against him and he was therefore able to conclude matters and move forward with his life.
