Our client had been accused of sending messages to his ex-partner via Snapchat and also attempting to call her. This was directly prohibited by a court order he had received around 6 months earlier which prevented him from contacting her.

The complainant had signed a statement and was willing to take matters further at the time the allegation was made and our client was terrified of losing his job as a result of a court prosecution. He instructed our specialist lawyers to ensure that he stood the best chance of getting the case dropped.

We represented our client at his police interview and our expert lawyer was able to analyse the situation once he had spoken to the officer. It was clear that, although the complainant had been supporting a prosecution at the time of the allegation, she was no longer as sure as she had been. In light of this, we advised that our client make a no comment interview. This ensured that no further evidence was given to the police which could potentially strengthen their case. If it transpired that the complainant no longer wished to pursue a prosecution, then it was likely the case would be dropped.

in fact, this is exactly what happened and, over the following weeks, the police concluded that they did not have enough evidence to proceed with the investigation and the case was closed. Our client was able to return to work without a police investigation hanging over him.
