Case study
Our client was living with his young daughter, brother and sister-in-law in their late mother's house. One evening, there was a dispute between our client and his brother over who should take ownership of the house. The police accused our client of squaring up to his brother and then proceeding to hit and bite him. His brother's wife intervened and our client is said to have punched her in the face.
Our client requested us at the police station because we have represented him previously for separate matters. One of our expert assault solicitors attended the police station and discussed the evidence with the officer in charge of the case. During this discussion, it became apparent that the police had no evidence to support their case. The complainants had not provided witness statements, however, our client had previously been arrested and convicted for similar incidents.
During a conference with our client, he explained that he was the one who had been assaulted by his brother's wife. She wanted him to move out of his mother's home so that she and her husband could have the house to themselves. We documented photographs of the injuries which he had received during the assault and then provided our advice for the interview.
Following the interview, the police decided to take no further action against our client and he was able to return to his family home and restore the relationship with his brother and his brother's wife.
