Case study summary
We represented our client at a police station interview after he was arrested for an accusation of assaulting and stalking. The police offered no evidence to prove any accusations but sent the case to the CPS regardless. We ensured that the case was closed.
Case study
Our expert lawyers were called to represent a young man at his police interview after he was initially arrested for assault and stalking.
After arriving at the interview, our client was further arrested for criminal damage and attempted burglary.
We engaged with the evidence that the police could provide during the disclosure stage of the interview and advised our client on the weakness of the police case. Despite the police's confidence, it was clear that there was no strong evidence to prove their case.
We continued to monitor the case after the conclusion of the interview and found that the case had been submitted to the Crown Prosecution Service for at charging decision, despite having no substantial evidence. The delays this caused left our client trapped by bail conditions, preventing him from being able to move on and continue his life, until we were able to persuade the police to drop these conditions.
Only one month later, the Crown Prosecution Service had no choice but to return the case to the police and, ultimately, no further action was taken.
Our client was able to move forward with his life and leave this unfortunate experience behind him.
