Our client had been drinking alcohol at their home when his partner began to shout verbal abuse at him and became violent. Both parties were arrested but the police took the incorrect view that our client was the aggressor. We persuaded the police to drop the case.
Case study
Our client was a 42-year-old computer programmer. He had been drinking alcohol at home with his partner when she began shouting and verbally abusing him. Our client tried remove himself from the situation, but his partner followed him. He exited the house and, in an attempt to drag him back inside, she scratched his face and ripped his T-shirt.
His partner then bit his chest and would not let go. Our client reacted by trying to hit his partner's head away from him. His partner's daughter phoned the police and both parties were arrested.
The police took the incorrect view that our client was the aggressor. His partner was released but our client remained under investigation with bail conditions preventing him from contacting his partner or living at his home address. This had a detrimental impact on our client's mental health, so he contacted us and asked us to represent him.
We drafted a letter to the police which explained why the investigation should be dropped. Our client's partner, and her daughter, realised that she was in the wrong, so they had both refused to provide a statement to the police. Therefore, they had no real evidence. Our letter highlighted this fact and forced the police to reconsider the case.
The police did so, and the case was dropped. Our client was relieved and was able to move on with his life.
