Following an argument with his ex-partner, our client was alleged to have entered her property without her consent, kicking her and taking her purse when he left. We disputed the allegation in court and ensured that the right result was achieved.
Case study
Our client had been arguing with his former partner via text and she had alleged that he had then come to her address and assaulted her, causing an injury to her face and ripping her T-shirt. She also stated that he had taken her purse as he left her property.
Our client instructed our firm when he realised that he needed specialists on his side. He explained that he had been arguing with his ex-partner but that she had invited him to her house to talk. However, when he arrived, the argument continued and she began hitting him and pushing him back. He had only acted in self-defence and pushed her away from him. He had then exited the property and had not stolen anything in the process.
During the trial, our specialist advocate advanced our client's account and cross examined his ex-partner. The prosecution had failed to provide any proof of an injury and the complainant was unable to justify her account in front of the court. Ultimately, our client was found not guilty and avoided what could have been a prison sentence.
He was able to move on with his life and put this matter behind him.
