Case study summary

Our client was an 18-year-old who had been accused of rape after travelling down to Barnsley to meet a girl. He was scared and turned to our specialist lawyers to ensure that the case was dropped.

Case study

A young man who had no previous involvement with the police, our client was accused of raping a girl after staying with her in a hotel in Barnsley. The complainant stated that he had invited her to his room and they had drank alcohol before falling asleep. She then stated that she had woken up to our client being on top of her and having intercourse with her.

He was asked to attend an interview at Carlisle Police Station in relation to this and instructed our firm to represent him. He explained that he had, in fact, been invited down to Barnsley by this girl and they had agreed beforehand that they would have sex. She had attended his hotel room with one of her friends and they had all drank some alcohol before her friend left the room. They then proceeded to have consensual sex that night and spoke frequently afterwards. Our client even had a picture from the complainant, which she sent to him two days after, bragging about how she had taken his virginity.

Prior to the interview, our specialist lawyer drafted a detailed prepared statement on behalf of our client, setting out his account of the night and denying the allegation against him. We ensured that the police were supplied with the picture that the complainant has sent to him and any other evidence that proved that the night had not occurred as she had suggested.

The police, having seen and heard his account, dropped the investigation and issued an apology to our client and his family, who had been through such a horrific time.
