Case study summary
Our client was a young man with learning difficulties, who had been accused of asking a 9-year-old to touch him sexually. Our specialist criminal lawyers represented him during the police interview and left the officers no choice but to drop the case.
Case study
Our client was a very vulnerable young adult. He struggled with learning difficulties and poor literacy.
A teenager, who had made sexual allegations against others, also reported that our client had asked him to touch him appropriately when he was 9-years-old . Our client would have been about 16 at this time. The teenager had made this comment verbally to officers but he had not provided a written statement or a video interview.
Our client was terrified at the thought of having to go to a daunting police interview. With the help of his family, he got in touch with our firm and instructed our specialist criminal lawyers to represent him. We ensured that his father could attend the interview with him as an appropriate adult and source of emotional support.
After carefully considering the situation and having a detailed conference with our client, we decided that the right approach was for the client to answer no comment to all questions put to him during the interview. The police simply did not have enough evidence to charge our client and our client did not have anything to gain by giving the police information they did not have.
After the interview, the police dropped the case without even referring it to the Crown Prosecution Service for a charging decision.
Our client and his family are able to move on with his life.
