Case study summary
The CPS decided to take no further action against our client who was accused of raping his stepbrother when they were both children. We represented the client during his interview and subsequently worked to ensure the investigation moved as quickly as possible during this stage.
Case study
Our client was accused of multiple counts of rape against this step brother when they were both children, 12 and 9 respectively. Our client is a respected lecturer and so having a criminal record could have dire effects on his career.
The client came to us for representation prior to a voluntary interview took place. We worked to ensure that a lawyer at the firm was able to attend the interview, and worked with the police to find a time that worked for all involved.
Upon attending the interview, and having discussions with the client, we advised that he should not put forward an account as this would not be advantageous at this time.
A lengthy investigation ensued from this; however we ensure that we kept contacting the investigating officer to ensure the case was being dealt with swiftly and not at risk of falling through the cracks. We ensured we kept in communication with the client regularly to try and keep his anxiety around the situation at a minimum.
While waiting for a charging decision to be made by the CPS, we gathered as much information and evidence from the client as possible to prepare for the possibility that this matter is taken to court. The CPS ultimately decided not charge him. The client was extremely relived about this outcome as he had suffered a great deal of stress and anxiety during the investigation. He was now able to move on with his life.
