Our client was a young father of two who worked full-time to support his family and had no previous convictions. He and the mother of his children had separated amicably and they continued to work together to raise their children.

Our client’s former partner had a younger sister. She had approached her teachers and alleged that our client had raped her. Our client saw that this could affect his employment and access to his children, so he contacted our specialist sexual offence lawyers and instructed us to defend him.

We discovered that the police had no substantial evidence. Whilst the girl had made a complainant to her teachers, she was refusing to provide any form of verbal or written statement. Without this, there was no real prospect of our client being charged. With the evidence being so limited, the correct approach was for our client not to put forward any comment in interview, as it would be providing the police with information that they may not otherwise have had. This left the police with no choice, other than to drop the case.

Our client was relieved that his ordeal was over, he can return to focusing on his job and children.
