Our client had been accused of rape by a 19-year-old family friend. He was adamant of his innocence and instructed our firm. The case was dropped following the police interview after the inconsistencies in the complainant's account were highlighted.
Case study
Our client had been contacted by the complainant on Facebook after she had an argument with her mother. She had gone back to his address and drank some vodka with our client before falling. She awoke believing that she had been raped by our client but could not recall how this had happened. There was also no forensic evidence that suggested our client had done anything.
Our client completely denied that any sexual contact took place. He explained that the complainant had contacted him and she seemed upset. He had picked her up in his car and taken her back to his address, They had drank some alcohol and, as far as he was aware, had both fallen asleep on his bed.
During the police interview, we advanced our client's account by way of prepared statement, advancing his denial and questioning the complainant's account in light of the lack of supporting evidence. A few weeks later, the police confirmed that the case had been dropped.
Our client was extremely relieved and was able to get back to his life without the fear of criminal prosecution.
