Case study summary

Our client was accused of seriously injuring her 6-month-old baby. She had been through intense Family Court proceedings and was now in the Crown Court. We challenged medical evidence and made a successful application to discontinue the case at trial. Outcome - Not Guilty.

Case study

Our client had been through hell and back after being accused of assaulting her 6 month old baby, almost 5 years ago. She was charged with her ex-partner and the prosecution could never decide who they thought was responsible for inflicting the almost fatal injury.

We spent many hours with our client getting her background details, details of her pregnancy and birth and the child's health leading up to his collapse. This was a distressing process for but we supported her through it. We were able to challenge the medical evidence and instructed a specialist barrister to represent her in court.

During the trial, the prosecution's case was flawed and we decided to apply to discontinue the case at half time. This was successful and the Judge ordered the Jury to return not guilty verdicts on behalf of our client.

As a result of this, our client can continue her fight in being able to see her children again. This was a particularly distressing case and one which needed a high level of sensitivity when guiding our client through such a difficult process.
