Case study summary

Our client was a 55 year old man with an exemplary record. Following an allegation of sexual assault we advised him to have a Crown Court trial with a jury. His case was carefully prepared and expertly presented. The jury reached a unanimous not guilty verdict in under two hours.

Case study

Our client was professional man who had never been in any trouble before and was a respected member of his local community. He had attended a Christmas market with friends, where he was accused of sexually assaulting a complete stranger. He was arrested and charged with Sexual Assault contrary to s.3 of the Sexual Offences Act 2004.

He was devasted by the allegations and what would have to his reputation and career if he was found guilty. He strongly denied sexually assaulting the person who has made the allegation but did not know how to fight his case.

We were instructed to represent him for the court proceedings after he was charged. We obtained the prosecution evidence and provided expert advice on the best way to proceed with fighting his case. The evidence was looked at in detail to identify differences in what various witnesses had said. Statements were also taken from defence witnesses who gave evidence at court not only about the allegation but also about our client's good character. We also instructed and expert barrister to present the case to the jury.

Our client was found not guilty and was able to carry on his life and maintain his good name after more than a year of stress and anxiety waiting for the case and worrying about being convicted for a crime he did not commit.
