Case study summary

Our client was charged with criminal damage after being seen scratching a car in a carpark.

We prepared extensive mitigation showing the pressure she was under as a single mother with a long-term health condition.

She received a conditional discharge in a single hearing.

Case study

Our client was a single mother who suffered with a long-term medical condition that required her to attend regular hospital appointments.

She approached us after being charged with criminal damage when she scratched a car in a hospital carpark following an argument with the owner of the vehicle. We listened to her side of the story and the difficulties she had been going through in light of her long-term health conditions.

We prepared robust and extensive mitigation in advance of the first hearing at the Magistrates' Court. Our mitigation focused on the stress and struggles that our client had as a mother with limited support and a longstanding health condition.

We then represented her at court and put forward her mitigation to the Magistrates.

The result was that our client received a conditional discharge and a fine to repay the value of the damage. She was able to leave the court after this single hearing and return to her life without the weight of this case hanging over her.
