Our client had been arrested for assaulting and controlling his partner. The reality was it was he who had been attacked and controlled but could not escape the relationship. We provided messages and audio footage which proved this and the police rightfully dropped the case.
Case study
Our client contacted us after he had been interviewed in relation to allegations of assault and controlling and coercive behaviour. The complainant was his long term partner which made the situation exceptionally difficult. Having been a victim of assault and control himself, he knew he needed experienced lawyers to prove the reality of the situation to the police. This is why he contacted and instructed us.
During our first conference, we spent several hours speaking with our client to understand the history of his relationship with his partner. It was clearly a passionate relationship full of fun trips and luxurious gifts but with the passion came hostility. However, the hostility was not caused by our client but his partner. He was shocked to find himself under investigation for the very offences his partner had committed against him.
Knowing it would be one person's word against another, we worked with a client to find any physical evidence which would support his account. Thankfully, he had numerous text messages containing threatening language. Our client also had lengthy voice notes which were nothing short of verbal abuse. We knew instantly that this would show the other side to these allegations.
To ensure effective delivery, we first spoke with the officer in the case to discuss the status of their investigation. At that point, they were still conducting enquiries and so we knew now was the time to deliver our client's material. We provided the audio files alongside a handful of text messages and asked that the officer consider these urgently.
Shortly after, the police made the correct decision to take no further action against our client due to the evidence we provided. As a result our client was not only able to move on from the false allegations but recover from the relationship he had wanted to escape from for so long.
