Case study summary

Our client was accused of sexual assault after a date with a woman. He was a professional man working for the NHS with a completely clean record. Our sexual assault lawyers advised him in detail in the interview and made written representations to the CPS, who dropped the case.

Case study

Our client had been out on a date with a woman he had met on a dating app. Shortly after, the woman accused him of sexually assaulting her.

Having never been in this type of situation before, or in fact any trouble at all in his entire life, our client was in a state of shock and panic. As he was worked for the NHS, he was also terrified about how this type of allegation could damage his career. He also suffered from long term anxiety which made the whole experience much more difficult to handle.

He was called by the police who asked him to come in for a voluntary interview. His first step was to contact our specialist sexual assault solicitors. We got in touch with the investigating officer straight away to make sure that any further contact came through us and not the client. We then requested disclosure in advance of the interview so that we could go through this with our client beforehand. We then took his detailed instructions about what really happened. He gave us a full account of everything that had taken place during the whole evening.

Sadly, the police failed to provide us proper disclosure of the allegation before the interview. This meant that we had to carefully think about strategy and what information we should put forward on our client's behalf. After hours of consideration, we drafted a detailed prepared statement which we submitted in the interview. We then urged the Crown Prosecution Service to look at the file and consider the statement. They duly decided that the case should be dropped without any charge or court proceedings.

Our client was massively relieved and was able to begin the journey of recovering from his ordeal and continuing his career.
