Case study summary

Our client was charged with drink driving. She was a civil servant of good character. She accepted she had driven over the limit. Our specialist motoring lawyers successfully argued that this was an exceptional case. Result - Minimum Disqualification Period.

Case study

Our client accepted that she had drunk way over the prescribed limited. She was in a period of turmoil at the time and had gone through the difficult breakdown of her marriage, suffering with alcohol addiction and chronic loneliness as a result.

The charge related to an evening where she had been alone in the pub. In a serious lapse in judgment, she then decided to drive to a local fast food chain. Two police officers then pulled her over. She admitted she had been drinking alcohol and was subsequently found to be over the limit.

In this moment, she instructed our specialist motoring lawyers. We quickly took instruction and found this to be a case where there was ample personal mitigation. We prepared an extensive package of mitigation for the court, throwing all of our efforts into reducing her disqualification period as much as possible. We also instructed a barrister, well-experienced in motoring law, to present her mitigation in court.

The court were persuaded by the mitigation we provided and disqualified her from driving for 10 months, far lower than the average sentence for drink driving.

The client was delighted with the result and very relieved to be able to put this part of her life behind her without excessive punishment and no prison time.
