We represented a young man who had been accused of rape following an encounter after a work party. Despite making the allegation, no formal account was provided by the complainant. We placed pressure on the authorities to expedite their investigation, reminding them of their duty of care not just to the complainant, but also to our client.
We had a comprehensive meeting with the client, where we took his instructions right up until the moment of his arrest. This allowed us to substantiate our correspondence with the police, citing his personal circumstances, his deteriorating mental health, and the drastic affect the allegation had had on him, as well as the glaring fact that the complainant had refused to provide a proper account.
Similar investigations can last many months, sometimes even years, and our work contributed to having the case discontinued in less than three months. Our client can now move on with his life and complete his degree in law at university.
