Case study summary

Our client was accused of raping his girlfriend and engaging in sexual activity in front of his child. We drafted pre-charge representations evidencing the allegations were malicious, and consequently the police discontinued the investigation.

Case study

Our client's ex-partner alleged that he had raped her and engaged in sexual activity in front of his young child.

He was a professional man and became distressed that he might lose his job and custody of his child.

He was historically in an unconventional relationship with the complainant over a period of many years. They lived in different countries, both had children and ultimately concluded they could not continue the relationship.

After spending significant time going into the background of their relationship, it became clear that the allegations were false, and the complainant was intentionally making false allegations out of spite because he called time on the relationship.

Our client had kept WhatsApp messages and emails that the complainant had sent to him and his family members which were malicious. We drafted a chronology of events, disclosed the malicious communications to the police and drafted pre-charge representations evidencing why the investigation should be discontinued.

Consequently, the police decided to take no further action on both counts and he was understandably relieved and grateful to be able to finally move on with his life.
